Praktik Penebangan Pohon Di Hutan Lindung Dalam Pelaksanaan Pacu Jalur Dikaitkan Dengan Undang-Undang Nomor 18 Tahun 2013 Tentang Pencegahan Dan Pemberantasan Perusakan Hutan
ABSTRACT
One of the cultural diversity is seen in the ceremony. Riau Region has an open,
accommodating and adaptive Malay culture with a system of religious and customary
values and traditions contained. The Kuantan Singingi community has a very popular
competition not only among the people, but also at the provincial and even national
levels, namely Pacu Jalur. The Pacu Path Festival is one of the proud traditions of the
people of Kuantan Singingi Regency in particular and the people of Riau Province in
general. For the needs of carrying out the spur-of-the-road tradition, which requires
large wood, the indigenous people cut down large trees in the forest, including in the
protected forest in Kuantan Singingi Regency. Therefore, the formulation of the problem
in writing this thesis, namely: first, how is the practice of felling trees in protected forests
in the implementation of spur lanes related to Law Number 18 of 2013 concerning
Prevention and Eradication of Forest Destruction?. Second, what is the positive legal
perspective regarding felling trees in protected forests in the implementation of spur
lanes in Kuantan Singingi Regency?
The type of research or approach used by the author is sociological juridical law
research. What is meant by sociological juridical research is an approach by looking at
the laws and regulations, in this research based on customary law and the reality that
occurs in the object of research. This research was conducted in Kuantan Singingi
Regency. Sources of data used, namely: primary data and secondary data. Data
collection techniques are interviews and literature review, and this research was
analyzed using qualitative analysis.
The conclusion that can be drawn from the results of the first research, the
practice of felling trees in protected forests in the implementation of spur lanes based on
Law Number 18 of 2013 concerning Prevention and Eradication of Forest Destruction is
a criminal act in accordance with Article 12 which states that everyone is prohibited
from: trees in forest areas that are not in accordance with forest utilization permits.
Second, felling trees in a protected forest in the implementation of a track in Kuantan
Singingi Regency based on a positive legal perspective is a crime that must be subject to
criminal sanctions in the form of imprisonment and a fine, because felling trees in a
protected forest in the implementation of a track in Kuantan Singingi Regency causes
damage forests that indirectly damage existing ecosystems and the sustainability of forest
functions is disturbed, then human rights are neglected. For the Regional Government as
the person in charge in order to be able to provide socialization to the community that
cutting down trees in a protected forest is a criminal act if it does not have a valid permit
from the relevant government. So that in the future people will not cut down trees
illegally anymore. Carrying out more programmed and running Pacu Path activities
without harming any party must be a priority for the government and the community in
Kuantan Singingi Regency.
