Upaya Hukum Yang Dilakukan Pt. Agrimitra Utama Persada Terhadap Konsumen Atas Informasi Kandungan Produk Di Dalam Air Minum Kemasan Sms Yang Tidak Sesuai
ABSTRACT
Consumer protection is an integral part of sound business activities. In a
healthy business activity there is a balance of legal protection between consumers
and producers. The absence of balanced protection leaves consumers hi a weak
position. Moreover, if the product produced by the producer is a limited type of
product, the producer can abuse his monopolistic position.
This of course will harm consumers. PT Agiimitra Utama Persada, where the
company produces bottled water under the Healthy Drink Source (SMS) brand, on the
company label says the water source comes from the Shiggalang Moimtahis, but hi
fact the water comes from the Regional Drinking Water Company (PDAM). As a
result of this, several products are now sealed due to different labels hi the mineral
water warehouse hi the SMS brand packaging.
This type of research can be classified hi the type of sociological law
research (empirical), because hi this study the author directly conducts research on
the location or place under study hi order to provide a complete and clear picture of
the problem being studied. This research was conducted at the PT. Agiimitra Utama
Persada, while the population and sample were the Manager of PT. Agiimitra Utama
Persada, Affected Consumers and SMS Distributor of Packaged Mineral Water
(AMDK).
The conclusions that can be obtained from the results of the study are First,
the responsibility of PT. Agrimitra Utama Persada to consumers for inappropriate
information that must be carried out by PT. Agiimitra Utama Persada from this
problem is related to the violation of consumer rights, namely First, the right of
consumers to get compensation, compensation for suffering economic losses
(economic loss). Second, the right of consumers to obtain correct tnformatton about
products with appropriate and honest labels hi accordance with the provisions of
Article 4 Number 3 of Law Number 8 of 1999 concerning Consumer Protection. This
should get serious attention from business actors, however, the existence of
consumers is very important for business actors. Business actors and consumers
basically need each other which has a mutualistic symbolic relationship. So that
consumers need to be nurtured, maintained, and maintained their existence. Second,
the efforts made by PT. Agiimitra Utama Persada to consumers for information that
is not in accordance with article 4 of Law Number 8 of 1999 concernnig Consumer
Protection is not satisfactory to distributors, should provide adequate protection to
the interests of consumers distributors is an important and urgent matter to find a
solution immediately , especially in Indonesia given the complexity of the problems
related to consumer protection.
