ABSTRACT
Buying and selling in Article 1457 of the Civil Code is an agreement in
which one party binds himself with another party to pay the price that has been
promised. In writing this thesis the author discusses the responsibility of the seller
to the consumer if there is a hidden defect, namely in article 1504 of the Civil
Code. Liability is a condition where business actors are obliged to bear
everything, business actors are aware of the responsibility for buying and selling
used cars if there are hidden defects that are intentionally known or unknown.
Responsibility also means acting as an embodiment of awareness of the
obligations of business actors to consumers. In this writing, the writer focuses on
the implementation of buying and selling used cars at the Pekanbaru City Car
Showroom. The purpose of writing this thesis: First, to find out the
implementation of a used car sale and purchase agreement in a car showroom in
Pekanbaru City. Second, the responsibility for hidden defects in the
implementation of buying and selling used cars at a car showroom in Pekanbaru
City, Pekanbaru City. The author conducts research with sociological legal
research methods, namely research conducted by conducting legal identification
of how the effectiveness of law enforcement applies in society.
This research is classified in the type of sociological research, because it
directly conducts research on the location or point being examined to provide a
complete and clear picture of the problem being examined. This research was
conducted at the ADM Car Showroom, ARM and JM Pekanbaru City, while the
sample population was all parties related to the problems studied in this study,
the data sources used, primary data and secondary data, data collection
techniques in this study with interviews, literature review, and data analysis.
From the results of the study, there are two main things that can be
concluded: First, the study of the implementation of buying and selling used cars
at the Pekanbaru City car showroom. Second, responsibility for hidden defects in
the implementation of buying and selling used cars at car showrooms in
Pekanbaru City, Pekanbaru City. The author's suggestion, in this study, is, to the
business actor as the seller in order to make a complete agreement, namely by
paying attention to the time clauses of the guarantee against hidden defects of
used cars being traded. So that later if the car has problems when purchased, it
can provide legal certainty regarding who is responsible for used cars that have
hidden defects in the object of sale and purchase.
