ABSTRACT
In Indonesia, the crime of adultery is regulated in Article 284 of the Indonesian Code of
Law where the crime regulated in this article is an absolute complaint offense. This means
that the perpetrator cannot be prosecuted if there is no complaint from the husband or wife
who is harmed. Customary law views differently, even though there are no complaints from
parties who feel aggrieved, this is still considered a violation of customary law and must be
tried according to adat. in the eyes of customary law. Customary law is still used in certain
areas. Especially in Bandur Picak Village, Koto Kampar Hulu District, Kampar Regency,
where the community still uses customary law to resolve crimes that occur around the
community, especially the crime of adultery. The purpose of writing this thesis are: First,
How is the Settlement of the Crime of Adultery in Bandur Picak Village, Koto Kampar Hulu
District, Kampar Regency, Second, What are the obstacles in implementing the Kampar
customary law in the settlement of the crime of adultery in Bandur Picak village, Koto
Kampar Hulu District , Kampar Regency, Third, What are the efforts to overcome the
obstacles in implementing the Kampar customary law in the settlement of the crime of
adultery in Bandur Picak village, Koto Kampar Hulu sub-district, Kampar Regency.
This type of research is classified as a sociological juridical research type because in
this study the author directly conducts research on the location or place under study in order
to provide a clear and complete description of the problem under study. This research was
conducted in Bandur Picak Village, Koto Kampar Hulu District, Kampar Regency, while the
population and sample in this study were all parties related to the problem being studied.
Sources of data used are primary data, secondary data and tertiary data. Data collection
techniques in this study are interviews, observation and literature study.
Based on the research results, the settlement of the crime of adultery through the
Kampar customary law is more effective because the sanctions given are adjusted to the social
and economic conditions of the community. Customary law also emphasizes family values
where big problems are minimized and small problems are eliminated, customary law also
ensures that problems that have been traditionally resolved must be completely resolved and
will no longer be a problem in the future.
