ABSTRACT
Lease is an agreement, whereby one party (the regional company Bimex)
binds itself to provide enjoyment of an item to another party (the Tenant) for a
certain period of time, with payment of a price agreed by that party. If the rights
and obligations of each party are not fulfilled, it can be called a default.
The location of this research is the Regional Company Bimex Bengkulu.
This study aims to determine the implementation of a rental contract for a car
wash place between a Bimex Bengkulu Regional Company and a tenant in the city
of Bengkulu and to determine the settlement of a contract default for a car wash
rental contract between a Bimex Regional Company and a tenant in the city of
Bengkulu.
This research is an empirical juridical research, the population is Bimex
Regional Companies and tenants, the samples are Director of General Affairs and
Finance of Bimex Regional Companies, Head of General Section of Bimex
Regional Companies and Tenants. Sources of data in this study are primary,
secondary, and tertiary data. Data collection techniques used are literature study,
interviews, and documentation. The analysis carried out is an analysis of a
qualitative approach.
Based on the results of this study, the authors conclude that the
implementation of the car wash rental contract between the Bimex Bengkulu
Regional Company and the tenant in the city of Bengkulu was not carried out in
accordance with the agreed contract. Default that occurred between the Bimex
Regional Company and the tenant in the form of a tenant violated Article 2 point 2
of the Car Wash Rental Contract Number 81.C/V.2/SP/BIMEX/III/2021, namely
the tenant was late in paying the rental fee of Rp. 11,000,000.00 (eleven million
rupiah).
The tenant violates Article 3 point 2 letter c of the Car Wash Rental
Contract Number 81.C/V.2/SP/BIMEX/III/2021, namely the tenant does not
maintain and maintain the cleanliness of the rental object as intended. The
settlement that can be taken by the parties in the car/motorcycle washing business
lease is a settlement through non-litigation channels, namely deliberation and
consensus. Deliberation has been agreed upon by the parties but the
implementation is not in accordance with what was agreed upon by the parties.
The tenant does not keep his promises and obligations.
