Recently, the Indonesian National Police continues to be tested for its
image due to being hit by various cases such as bribery, corruption, human rights
and various other criminal cases. One case has not yet been completed, a new
case has emerged. But now public opinion is developing that it seems as if every
member of the Police is above the law because of the many cases involving the
police “yawning” before arriving at trial. There are many violations committed
by the police whose violations are not in accordance with what has been
mandated by the institution concerned. This thesis discusses the criminal
responsibility of a police officer in the event of an omission of a criminal act.
This type of research can be classified in the type of normative legal
research. Sources of data used, namely secondary data in the form of: primary
legal materials, secondary legal materials and tertiary legal materials. The data
collection technique is literature study. Data analysis was carried out
qualitatively.
The responsibility of a police officer who allows the occurrence of a crime
in this case can be subject to criminal sanctions. The appropriate article and can
be imposed on the act of allowing the criminal act to occur is Article 531 of the
Criminal Code. With the imposition of this article, police officers who violate it
can be tried in court after receiving a first code of ethics trial within the internal
police organization itself. So that in submitting a member of the police to the
court for trial in accordance with the Criminal Procedure Code, it can be carried
out and must be subject to punishment in accordance with what has been
stipulated in the Criminal Code. In terms of accountability, a police officer who
allows a criminal act to occur is given administrative sanctions in the form of
being transferred to a different position, being transferred to a different area,
honoring discharge and dishonorable discharge. The police should be consistent
with the duties and functions that have been mandated and promulgated by law to
an institution in terms of the security of the Indonesian state. And the Police must
increase morale and establish partnerships with the community, and make the
community a place to share and make people believe in the Police.
