ABSTRACT
Divorce is the breaking of the marital bond between a man and a woman
which results in the termination of the relationship between the husband and wife.
The existence of a divorce has consequences which are regulated in Article 41 of
the Marriage Law. From the consequences of the divorce, it is the obligation of
parents to fulfill the children's rights from the divorce. This study aims to find out
how the fulfillment of children's rights from underage marriages according to
positive law and Islamic law in Muara Bahan Village, Singingi Hilir District,
Kuantan Singing Regency and to find out the obstacles in fulfilling children's
rights due to divorce from underage marriages. The type of research used is
sociological research. The types of research data are primary data and secondary
data. The data analysis technique used is qualitative data analysis.
The results of this study are the obligations of parents to fulfill children's
rights after the divorce in accordance with what is stipulated in the law increase
parental awareness of the law so that no more children's rights are not fulfilled
after a divorce occurs and also the role of village institutions and population
control services, family planning, women's empowerment and child protection in
helping the fulfillment of children's rights. The obstacles that cause children's
rights to be unfulfilled due to divorce are the lack of legal awareness of the
community, not being sued in court, economic factors, and the factor of parents
remarrying.
