ABSTRACT
In the community, a lot of fuel oil is not in accordance with the procedures that have been regulated, even in the practice of selling it, it is very dangerous for the safety of sellers and consumers. This is also in accordance with Law no. 8 of 1971 concerning Pertamina which states that Pertamina is the regulator, as well as the only business entity in the oil and gas sector, this rule was developed into Law no. 22 of 2001 on oil and gas.
This type of research can be classified in the type of sociological law research (empirical), because in this study the author directly conducts research on the location or place under study in order to provide a complete and clear picture of the problem being studied. This research was conducted in the Outer Sector Police, while the population and samples were the Head of the Criminal Investigation Unit (Economic Division) of the Peripheral Police, Investigators in the Criminal Investigation Division (Economic Section) of the Peripheral Police, the perpetrators of hoarding of Oil and Gas Fuel, and the community around the area. the Peripheral Police of the Republic of Indonesia. Sources of data used are primary data, and secondary data. Data collection techniques in this study were interviews, and literature review.
The conclusions that can be obtained from the results of the research are First, Law Enforcement of Criminal Acts of Transportation and Stockpiling of Fuel and Natural Gas in the Peripheral Sector Police which is currently being carried out is still not appropriate and less effective in the application of sanctions, both administrative sanctions and criminal sanctions. Law enforcement officials have implemented applicable regulations and have attempted to take legal action against processing fuel oil without a permit, transporting fuel oil without a permit, storing fuel oil without a permit, trading fuel oil without a permit, and misuse of transportation and/or trade against fuel oil. Second, Obstacles in Law Enforcement of Criminal Acts of Transportation and Stockpiling of Fuel and Natural Gas in the Peripheral Sector Police, namely because the police cannot simply carry out law enforcement processes against hoarders because there are reasons that make it easier for the community and accommodate the needs of fuel oil and natural gas in the community. . Third, the Efforts Made to Overcome Obstacles in Law Enforcement of Criminal Acts of Transport and Stockpiling of Fuel and Natural Gas at the Peripheral Sector Police, namely to raise legal awareness for the community by conducting direct socialization to hoarders that there are regulations regarding the sale of petroleum materials and so that the public knows what is being done. they can sell and what is the correct procedure for buying and selling fuel oil in accordance with government regulations.
