Politik Hukum Kewajiban Vaksinasi Berdasarkan Peraturan Daerah Kota Pekanbaru Nomor 7 Tahun 2021 Perubahan Atas Peraturan Daerah Kota Pekanbaru Nomor 5 Tahun 2021 Tentang Perlindungan Masyarakat Dari Penyebaran Dan Dampak Corona Virus Disease 2019
ABSTRACT
Nowadays,the world is being shaken by a great pandemic called Corona Virus Disease 2019. The beginning of the spread of Covid-19 that hit the world occurred in the city of Wuhan, China at the end of 2019. This virus spread very massively, so the Covid-19 outbreak caused an emergency.The Indonesian government has taken steps to protect the health of its citizens. One of the efforts being made by the government in order to protect the health of Indonesian citizens is the procurement of vaccinations. Therefore, the vaccination process is important in order to stop transmission. Responding to the high level of spread of Covid-19 in Pekanbaru, the Pekanbaru City Government stipulates Pekanbaru City Regional Regulation Number 7 of 2021, an amendment to Pekanbaru City Regional Regulation Number 5 of 2021 concerning Community Protection from the Spread and Impact of Corona Virus Disease 2019 in an effort to break the chain of the Corona virus.
In line with the obligation to vaccinate against the provisions of Article 5 paragraph (3) of Law Number 36 of 2009 concerning health and Article 28 H of the Constitution of the Republic of Indonesia 1945. Acceptance of administrative services and social security for every citizen, as well as refusing vaccinations are human rights owned by citizens. Every human being from birth has rights and obligations that are free and fundamental. However, the fact is that the Pekanbaru City Government has issued and ratified a Regional Regulation regarding the acceleration of vaccination in Pekanbaru City, where the Regional Regulation states sanctions firmly and clearly for every target recipient of the vaccine who doesn't vaccinate Covid-19.
This study was structured using qualitative analysis. Qualitative analysis produces descriptive data, namely collecting all the necessary data obtained from primary and secondary legal materials. This type of research is normative juridical, namely research that is focused on examining the application of rules or norms in positive law.
The results of the research conducted by the author are, first, the legal politics of vaccination obligations, in essence, must reflect on the principles of the formation of laws and regulations, one of which is the principle of openness. Where community participation is also a consideration in making a policy. In addition, the absence of clear rules for setting targets for vaccination the cause conflict. Second, knowing the ideal concept of vaccination obligation in the constitutional perspective of Article 28H of the Constitution of the Republic of Indonesia 1945. In connection with the Covid-19 pandemic, the vaccination policy in preventing the spread of the virus is a form of implementing the government's responsibility in ensuring the implementation of health which is part of the realization of welfare.
