Penerapan Restoratif Justice Dengan Diversi Terhadap Anak Pada Tahap Penyidikan Tindak Pidana Kecelakaan Lalu Lintas Di Wilayah Hukum Polres Bengkalis
The number of traffic accidents involving children and resulting in the loss
of a person's life or property causes unrest for road users, one of the contributing
factors is the lack of supervision by parents and those responsible for giving
permission to drive four-wheeled or two-wheeled vehicles without having a
driver's license.
This study aims to analyze the Implementation of Restorative Justice with
Diversion Against Children in Traffic Accident Crime Investigations in the
Bengkalis Police District and the Causes of Failure to Implement Restorative
Justice with Diversion Against Children in Traffic Accident Investigations in the
Bengkalis Police Legal Area.
This research is classified as a Sociological Law research conducted by
means of a survey, namely research directly to the research location using data
collection tools in the form of interviews.
The results showed that the Implementation of Restorative Justice with
Diversion Against Children in Traffic Accident Investigations in the Bengkalis
Police Legal Area that investigators must consider the category of the crime
committed, the age of the child, the results of community research from the
Fathers, and support from the family and community environment so that in
solving traffic crime cases where the perpetrators are children can be realized by
diversion efforts as mandated by Law no. 11 of 2012 concerning the Juvenile
Criminal Justice System which aims to achieve peace between victims and
children, by resolving children's cases outside the judicial process, thus
preventing children from depriving children of independence, encouraging the
community to participate and instilling a sense of responsibility in children.
Factors causing the failure of implementing Restorative Justice with Diversion of
Children in Traffic Accident Investigations in the Bengkalis Police Legal Area
include Human Resources (HR) related to Bengkalis Police Personnel in handling
cases of children at Bengkalis Police, Difficulty uniting thoughts between the
victim and the parties children in conflict with the law in order to reach an
agreement, Limited Facilities and Adequate Infrastructure in the Diversion
Process, The amount of compensation requested by the victim to the perpetrator is
not in accordance with the economic capacity of the perpetrator and the
perpetrator does not feel guilty for the accident that occurred.
