The application of ETLE does indeed bring benefits and greatly helps the
Riau Regional Police Traffic and Traffic Office in enforcing traffic laws, for
people who commit traffic violations, but unknowingly this also harms the
community, especially owners of rental or leased vehicles, where the vehicle
rented by the lessee commits a traffic violation. traffic, and when a fine is paid,
the owner of the rental vehicle is required to pay a fine resulting from a traffic
violation committed by the vehicle renter. Based on the background above, the
main problem in writing this thesis is how is the criminal responsibility of traffic
offenders through the ETLE system to rented four-wheeled vehicle drivers and
what are the obstacles in criminal liability for traffic violations through the ETLE
system to four-wheeled vehicle drivers who rent.
This study uses the Sociological legal research method, namely research
directly to the research location using a data collection tool in the form of
interviews.
The results of the study show that the application of ETLE is carried out
on rental vehicle owners, even if the rental vehicle owner does not admit to
having committed an offense, the rental vehicle owner must provide the identity of
the rental vehicle within 7 days to clarify, otherwise the police will carry out
blocking the STNK if the vehicle owner does not pay the fine, then the ERI system
will be blocked at Samsat, so that the vehicle will not be able to make tax
payments or change vehicle identity. The vehicles referred to here are vehicles
with black plates that are not permitted or illegally rented. The obstacles in the
criminal liability of perpetrators of traffic violations through the ETLE system are
the lack of socialization by the government and the police, Electronic ticket
settlement procedures are still relatively complicated, The problem of falsified
motorbike license plates, The mechanism for paying sanctions focuses on only one
bank.
