Pemenuhan Hak-Hak Tenaga Medis Di Rsud Indrasari Rengat Berdasarkan Perjanjian Kerja Di Masa Pandemi Covid-19
ABSTRACT
Indrasari Rengat Hospital is a type C government hospital engaged in the health sector located in Pematang Reba jl.lintas timur Sumatra, which has a work agreement with medical personnel (doctors). An agreement as described in Article 1313 of the Civil Code is an act in which one or more persons bind themselves to one or more persons. Agreements validly concluded apply as Acts to the parties making them. This means that the agreement is valid and legally binding on the parties. The rights and obligations of medical personnel are regulated in Law Number 36 of 2014 concerning Health Workers. In 2020, Indrasari Rengat Hospital became one of the referral places to provide health services to covid-19 patients. The implementation of the Decree of the Minister of Health provides incentives every month in exchange for the services of medical personnel who handle Covid-19 patients. However, in its application, this problem is not in accordance with the employment agreement reviewed from Article 57 of the Law on Health Workers regarding the right in letter (c) to receive service rewards and is associated with the Decree of the Minister of Health Number HK.01/07/4239 of 2021 concerning the Provision of Incentives and Death Compensation for Health Workers Handling Covid-19. The purpose of this study is first, to determine the fulfillment of the rights of medical personnel at Indrasari Rengat Hospital based on work agreements during the Covid-19 pandemic according to applicable regulations. Second, to find out the obstacles to fulfilling the rights of medical personnel at Indrasari Rengat Hospital based on work agreements during the Covid-19 pandemic.
This type of research is empirical or sociological juridical research. This research was conducted at Indrasari Rengat Regional Hospital, the population and samples were all parties related to the problems studied in this study. The data sources used are primary data, secondary data and tertiary data with collection techniques in research are qualitative.
The results of this study show that the fulfillment of the rights of medical personnel at Indrasari Rengat Hospital based on the cooperation agreement during the Covid-19 pandemic based on applicable regulations has not been fulfilled because of this, obstacles arise in fulfilling the rights of medical personnel at Indrasari Rengat Hospital based on the cooperation agreement during the Covid-19 pandemic due to the negligence of Indrasari Rengat Hospital in providing incentives and hampering the document verification process. The author's suggestion is for Indrasari Rengat Hospital to accelerate the provision of medical personnel incentives in a timely manner.
