Tanggung Jawab Negara Terhadap Hak Korban Pasca Terdakwa Meninggal Dunia
The state's responsibility for the rights of victims whose defendants
have passed away is a very important matter to be considered and given
protection by the state because it is a form of respect for human rights. It
is not only oriented towards the abolition of crimes as stipulated in the
Criminal Code, but is more oriented towards the form of restoring the
rights of victims of criminal acts who have died. It is very common to find
someone who has experienced physical or mental suffering as a result of a
crime that happened to themselves, and the victim does not use the rights
he should have received as an excuse, for example fear that in the future
people will know what happened to the victim because this incident was
shame for himself and his family, so it is better for the victim to hide it or
for the victim to refuse to submit compensation because they are afraid
that the process will be longer and could result in prolonged suffering. As
it should be the victim's right to be restored is a problem that needs to be
found a way out legally, whether the State will compensate the victim for
the crime. Apart from compensation, the victim also needs clarity about
the case, whether it is true that the case experienced is a criminal act or
not, especially regarding the rights of victims whose perpetrators have
died.
This study aims to find out how the state's responsibility for the
rights of the victim after the defendant dies and how is the recovery of the
victim's rights if the perpetrator of the crime dies, The research method in
this thesis uses the type of research used in writing this law is normative
legal research, namely an approach that is carried out by examining
literature or secondary data on legal principles as well as case studies
which in other words are often referred to as library law research. The
results of the research can be divided into two, namely: first, the state's
responsibility for the rights of the victim after the defendant dies, second,
restoration of the rights of the victim if the perpetrator of the crime dies.
