Itsbat Nikah is a process of determining the legalization of marriage for
husband and wife who have previously carried out a sirri marriage or private
marriage. The purpose of this marriage itsbat is to obtain a marriage certificate as
proof of the validity of a marriage in accordance with the laws and regulations that
apply in Indonesia. This happens because of a lack of understanding about the
legitimacy of a marriage held according to religion. This shows that if a marriage
fulfills the conditions and pillars of marriage, even though it is not held before a
Marriage Registrar, the marriage is considered valid according to religious law,
but this is not in accordance with State law. The importance of registering
marriages is because the registration is used as the basis for validating the
determination of marriage, known as itsbat nikah, so that the validity of the
marriage will be guaranteed according to religious and state law.
This type of research can be classified in the type of empirical research.
The research location is Kabupaten Kampar Utara, the data sources used are
primary data and secondary data. The data collection techniques collected were
interviews and literature review. After the data has been collected, it is then
analyzed qualitatively using the deductive method, namely drawing conclusions
from general matters to specific rights.
From the results of research on the implementation of the determination
of itsbat marriage in Kabupaten Kampar District, Kampar Regency which was
carried out at the Bangkinang Religious Court, the process went through several
stages, namely: registering with the Religious Court, paying court fees, waiting for
a summons from the Religious Court, attending trials and court decisions. There
were 46 cases of itsbat marriage applications submitted in 2020, in 2021 there
were 97 cases, in North Kampar District from 2020-2021 there were 5 (five) cases
of determining itsbat marriage, for various reasons, including for administrative
purposes such as arranging child birth certificates . The implementation of itsbat
nikah in North Kampar District is in accordance with the Laws and Regulations,
and the reason for the occurrence of itsbat nikah is to make a child's birth
certificate. The need for outreach to the public regarding the importance of
registering marriages and submitting them to the Religious Courts.
