Peran Ninik Mamak Dalam Pelaksanaan Perkawinan Di Nagari Simpang Lama Inderapura Kecamatan Pancung Soal Kabupaten Pesisir Selatan

ABSTRACT
In managing the administration of marriage, in addition to the conditions stipulated in the Marriage Law in Nagari Simpang Lama Inderapura, the prospective bride and groom who are about to marry must be granted the written approval for marry from the Ninik Mamak. This requirement is based on the additional rules of Nagari Simpang Lama Inderapura which require written approval from the Ninik Mamak for the marriage of his nephew's child that took place before they register their marriage to the authorized Office of Religious Affairs. Without the written approval from the ninik mamak, the Walinagari office as the party to create the marriage recommendation letter for the KUA will not further process the administration of the marriage file before the marriage permit is completed from the ninik mamak.
The purpose of this study was to find out the implementation of marriage in Nagari Simpang Lama Inderapura and to find out the role of ninik mamak in marriages in Nagari Simpang Lama Inderapura. The type of research for this thesis is sociological legal research, namely research conducted directly on location or in the field to obtain data to provide an overview completely and clearly about the problem under study. The location of this research was conducted in Nagari Simpang Lama Inderapura. Data collection techniques in this study were interviews and literature review. The collected data is then analyzed qualitatively using the deductive method, namely drawing conclusions from things that are general in nature to be specific.
From the results of the research conducted, it can be concluded that first, the implementation of marriages in Nagari Simpang Lama Inderapura is not only guided by the Marriage Law, but also guided by its customary rules. Where in the marriage administration needs, aside of the conditions stipulated in the Marriage Law, every niece's who is about to marry in Nagari Simpang Lama Inderapura need to seeking for a written marriage approval from the ninik mamak. In practice, without a marriage license from the ninik mamak, the KUA will refuse to carry out the marriage because this marriage license is as important as other marriage conditions. Second, in the case of child-nephew marriages, the role of ninik mamak cannot be separated from their daily duties and responsibilities. Ninik mamak has a very strong involvement in the marriage process of her nephew, starting from finding a mate, marambah, until the marriage ceremonies. In the marriage of her niece, the ninik mamak serves as a guide who will direct her nephew to the straight path in accordance with Islamic law and prevailing customs.
