ABSTRACT
Article 1548 of the Civil Code states that a lease agreement is an agreement in which one party binds himself to provide the other party with the enjoyment of an item, for a certain time and with the payment of a price that the party can afford. However, in reality the lessee defaults on fulfilling the lease agreement, namely the lessee does not pay the rental price as agreed in the agreed lease agreement. The purpose of this study is to explain the factors that cause defaults and the settlement efforts taken as a result of defaults on the rental agreement for renting a shop in Batu Bersurat Village, District XIII Koto Kampar.
This research is a sociological legal research. The research location is located in Batu Bersurat Village, XIII Koto Kampar District, while the population and sample are all parties related to the problem under study. This study uses data sources in the form of primary data and secondary data, and data collection techniques are carried out by means of interviews.
From the results of the study it was concluded that the factors causing the default in the rental agreement to rent a shophouse in Batu Bersurat Village, XIII Koto Kampar District were due to 3 factors, namely: (1) economic factors, namely factors related to finance, where the tenant explained that the shophouse being rented was used as a place for a restaurant business and the factors behind the default on the rental agreement for renting a shop in Batu Bersurat Village were due to the lack of buyers and sales of merchandise that did not reach the target. (2) the place for rent is not strategic, so that the business built in the shop does not run smoothly and causes the tenant to have difficulty paying the rent that has been agreed in the agreement. (3) Lack of understanding of tenants in understanding the contents of the lease agreement. The settlement efforts taken were initially by giving a subpoena or in the form of a written warning to remind them to pay the remaining payment of the rental price as agreed in the agreement. The existence of this subpoena does not solve the problem, so the next step is to take efforts to resolve it by means of mediation or deliberation in order to achieve peace between the parties. This effort is carried out by prioritizing a sense of justice, namely providing wise solutions in every problem that occurs. and Settlement efforts by way of deliberation are considered more effective and faster in resolving disputes.
