In article 67 number 8 of Law Number 6 of 2014 concerning Villages it is explained that the Village Consultative Body is prohibited from "becoming the administrator of a political party". Cases of multiple positions are quite commonplace in the nation and state, but their existence cannot be fully accepted and they are even more likely to be rejected due to many factors, for example, they can cause conflicts of interest, the occurrence of multiple incomes, weak supervision and so on.
This type of research can be classified in the type of Normative legal research, which reveals legislation relating to legal theories that are the object of research. The approach taken uses a qualitative analysis approach by looking for data both in books, journals and other scientific works related to this research. The data sources used are primary and secondary legal materials.
The conclusions that can be obtained from the research results are First, the political law prohibiting members of the Village Consultative Council as political party administrators based on Law Number 6 of 2014 concerning Villages and the impact or implications where the political law prohibition creates village regulations that are oriented to the function of protecting and channeling the aspirations of the village community, the supervisory function supervises the performance of the village head. In addition, confirms that the suitability is contained in Permendagri No. 110 of 2016 concerning the Village Consultative Body (BPD) Article 26 has explained that members of the BPD are prohibited from holding concurrent positions. Second, the ideal idea regarding the arrangement of members of the Village Consultative Council as Political Party Administrators where in Article 64 of Law Number 6 of 2014 Concerning Villages it is only explained that the Village Consultative Council is prohibited from holding concurrent positions. Of course, this article still creates misinterpretation, therefore the Village Consultative Body cannot hold concurrent positions as administrators of political parties, especially political parties funded by the APBN and APBD. The prohibition of concurrent positions on the Village Consultative Council in political parties in Law Number 2 of 2008 concerning Political Parties also contains no provisions that specifically regulate the prohibition of concurrent positions as political party administrators. The legislation also does not explain the concept of multiple positions clearly.
