Implementasi Temporary Protection Directive (Tpd) Uni Eropa Untuk Menangani Pengungsi Ukraina Di Jerman Tahun 2022
This research analyzes the implementation of the Temporary Protection Directive (TPD) of the European Union in the context of handling refugees in Germany in 2022. The main objective of the research is to analyze the implementation of TPD as a legal basis for temporary protection for refugees in Germany.
This study employs qualitative research methods with data collection techniques from various sources, including media reports, academic articles, and official documents related to the implementation of the European Union's Temporary Protection Directive (TPD) to address refugees in Germany in 2022.
The Temporary Protection Directive (TPD) is a regulation established by the European Union in 2001 to anticipate waves of refugees due to the Kosovo war in 1998-1999. However, the European Union has never utilized the TPD in practice. Until Russia invaded Ukraine in February 2022, causing forced migration from Ukraine. The refugee wave increased significantly as people sought safe havens. A massive influx of refugees entered the territories of EU member states because Ukraine shares a direct border with Ukraine. The European Union, as an international institution, played a crucial role in managing the refugee crisis by activating the Temporary Protection Directive to receive Ukrainian refugees. As a member state, Germany adopted the TPD as a legal basis for accepting Ukrainian refugees. Germany established the Ukraine-Residence-Transitional regulation and amended the Residence Act Section 24 to grant residency to Ukrainian temporary protection recipients. Under these regulations, TPD recipients in Germany are entitled to rights and benefits based on the German Social Code.
