Perlindungan Hukum Pidana Terhadap Pasien Gawat Darurat Akibat Kecelakaan Lalu Lintas Yang Diharuskan Membayar Uang Muka Sebelum Perawatan Dan Tindakan Operasi Di Rumah Sakit Swasta
The rampant actions of private hospitals asking for down payments before treatment and surgery for emergency patients due to traffic accidents have caused disability and or death in these patients because the upstream rokan general hospital has difficulty referring these patients. The Health Act of 2023 prohibits hospitals from refusing patients and or asking for advance payment for emergency patients. The objectives of this research are: 1. To find out the criminal legal protection of emergency patients due to traffic accidents who refuse to pay an advance payment for prior treatment and surgery in private hospitals according to laws and regulations. 2.To find out the application of sanctions against private hospitals that ask for an advance payment 3. To find out the efforts made to overcome the obstacles that arise during the referral process from private hospitals to emergency patients due to traffic accidents who are unable to pay an advance payment before treatment and surgery while in the hospital ER.
The research method or problem approach that will be used in this research is normative juridical, which is research conducted by examining secondary legal materials or research based on standardized rules that have been booked, also known as library research. This research focuses on finding facts related to legal protection, in terms of providing health services to accident victims in an emergency situation due to traffic accidents who are asked for an advance payment in private hospitals.
The results of the research of patients who are victims of traffic accidents, general public need to be protected based on existing regulations, so that they do not have to be charged with handling costs. based on the Health Law, it is explained that criminal sanctions against Private Hospitals that ignore and even ask for an advance payment to get health facility services are as follows: It is stated that the Head of a Health Care Facility may be subject to criminal sanctions of imprisonment for a maximum of 10 years and a fine of 2 billion Rupiah. The first effort that must be made to overcome obstacles related to accident victims is collaboration between local governments, private hospitals and health insurance and motor vehicle insurance.
