Pembaharuan Pelaksanaan Diversi Terhadap Semua Jenis Tindak Pidana Yang Dilakukan Oleh Anak Sebagai Bentuk Perlindungan Khusus Sesuai Kebutuhan Anak
The practice of juvenile justice in Indonesia is still far from the ideals set forth in Law Number 11 of 2012 concerning the Juvenile Criminal Justice System (SPPA). This can be seen from a number of data on the implementation of Diversion to the knowledge of law enforcement officials. Cases of children facing the law (ABH) until 2020, according to data from the 2021 Report on the Implementation of the Juvenile Criminal Justice System, which was quoted from the page of the Ministry of Women's Empowerment and Child Protection, shows that the Supreme Court recorded 5,774 cases. Of these, only 452 cases were resolved by diversion.
This type of research is normative law with the type of legal principles. Collecting data on normative legal research uses data collection techniques from a literature study. In drawing conclusions the author uses the deductive thinking method, namely a way of thinking that draws conclusions from a general statement or argument into a specific statement.
Based on the results of research and discussion it can be concluded. First, the urgency of updating diversion against all types of criminal acts committed by children as a form of special protection according to the needs of children needs to be carried out because criminal acts committed by children are serious problems that require special handling. Second, the concept of renewal of diversion against all types of crimes committed by children as a form of special protection according to the needs of children in the future can be carried out by increasing the effectiveness and efficiency of the child protection system. It is necessary to renew diversion for all types of crimes committed by children. This renewal aims to fulfill children's rights, encourage community participation, and increase the effectiveness and efficiency of the juvenile justice system.
