Narcotics crime is a dangerous crime, damaging the younger generation as well as the character and physique of the people who use it. This crime is also associated with a number of crimes, such as robbery, theft, money laundering and terrorism. Therefore, the crime of narcotics not only kills lives, but also kills human lives, even the wider community. Narcotics crimes not only kill tens of thousands of people every year, but destroy the lives and future of the nation's next generation.
This type of normative legal research is based on legal principles.
Collecting normative legal research data uses data collection techniques using library research. In drawing conclusions, the author uses a deductive thinking method, namely a way of thinking that draws conclusions from a general statement or proposition to a specific statement.
Based on the results of the research and discussion, it can be concluded. First, legal certainty that arises in the imposition of minimum sentences related to narcotics crimes is a situation that guarantees that the law can provide equal protection and justice for all perpetrators of narcotics crimes, in accordance with the provisions of the applicable law. Legal certainty also guarantees that the law can provide a sufficient deterrent effect on perpetrators and potential perpetrators of narcotics crimes, so that they can prevent the occurrence of narcotics crimes which can damage the health, morals and future of the nation. Second, the legal consequences of decisions below the minimum in narcotics crimes are the consequences caused by law for a decision issued by a judge that is not in accordance with the provisions of the law. This legal consequence can be in the form of the birth, change, or disappearance of a legal situation or a legal relationship between the parties involved in the case. The consequences of this law can also be in the form of legal sanctions if the judge's decision violates applicable law. These legal consequences can have a negative impact on legal interests, justice and community welfare, as well as reduce the credibility and integrity of judges as law enforcers.
