Ulayat land is a plot of inheritance land along with the natural resources on it and within it are controlled collectively by customary law communities in West Sumatra Province. Nagari Pangkalan Koto Baru is a nagari located in Pangkalan Kota Baru sub-district, Limapuluh Kota district, West Sumatra province. The customary land in the Pangkalan village is tribal customary land, but it has been variously divided into tribal customary land, but tribal leaders will also be able to gain benefits if the interests carried out are related to tribal interest.
Tribal customary land disputes were also experienced by nephews and nieces in Nagari Pangkalan Koto Baru, the dispute was over customary land donated by Dt. Sibijayo (Zakaria) to Sumarni’s nephew, then Dt. Sibijayo (Zakaria) died and was replaced by Dt. Sibijayo (Dainimal), without the knowledge of Sumarni’s nephew, the land was being bought and sold by Dt. Sibijayo (Dainimal). This research aims to determine the factors causing the emergence of the ulayat land dispute of the pitopang Dt. Sibijayo with his niece and nephew in Pangkalan Koto Baru, West Sumatra and learned about the resolution of the customary land dispute of the Pitopang tribe Dt. Sibijayo with his niece and nephew in Pangkalan Koto Baru, West Sumatra.
This research is empirical or sociological legal research. Sociological legal research is legal research that examines law which is conceptualized as real behavior. The research location is Nagari Pangkalan, Pangkalan Koto Baru District, Limapuluh Kota Regency, West Sumatra Province.
The results of the research show that the factors causing the emergence of the ulayat land dispute of the Pitopang Dt Tribe. Sibijayo with nephews in Pangkalan Koto Baru, West Sumatra, is a procedure for controlling customary land that is not clear, the deliberation process regarding customary land is not transparent, the process of handing over customary land is not open to each other and there are personal interests in terms of ownership of this customary land. These factors together caused the dispute over the customary land of the Pitopang Dt Tribe. Sibijayo with nieces and nephews in Pangkalan Koto Baru, West Sumatra. Settlement of customary land disputes of the Pitopang Tribe Dt. Sibijayo with nieces and nephews in Pangkalan Koto Baru, West Sumatra was carried out by resolving customary land disputes through the Nagari Pangkalan Adat Village (KAN) and resolving customary land disputes through the indigenous community of Pangkalan Koto Baru District.
