Perlindungan Hukum Potensi Indikasi Geografis Tenun Songket Pandai Sikek Sebagi Bagian Dari Kekayaan Intelekual Komunal
Songket Pandai Sikek is a Songket cloth originating from Nagari Pandai Sikek, X Koto District, Tanah Datar Regency which has been made from generation to generation since the 14th century. Songket Pandai Sikek has different characteristics from songket from other regions, has a good reputation, and still maintains its existence to this day. The thing that makes Pandai Sikek songket different from other songkets is the motif and manufacturing technique. On each edge of the songket cloth, it is mandatory or must be limited to 3 (three) motifs, namely the Batang Pinang Motif, Spinach Motif and Saluak Laka Motif. Between the Pucuak (songket head or tumpal) and the songket body motif (core motif) is limited to Cukie Kaluak. The Songket Pandai Sikek motif itself is taken from geographical environmental factors such as nature and humans. Songket Pandai Sikek is a cultural heritage that must be developed and preserved so that its continuity is maintained and has high economic value. Because of this, Songket Pandai Sikek has the potential to receive legal protection as a Geographical Indication so that it can provide benefits and can be owned communally by the Pandai Sikek community. Geographical Indications provide legal certainty for Songket Pandai Sikek. The aim of this research is to find out, describe and analyze the protection that can be carried out in realizing Geographical Indications for Songket Pandai Sikek, the obstacles in providing legal protection for geographical indications. This type of sociological juridical research is research that seeks to see the correlation between law and society, so as to reveal the effectiveness of the enactment of law in society. From the results of the research on the problem, there are two main things that can be concluded, firstly, the legal protection that can be given to Songket Pandai Sikek, namely preventive legal protection that is preventative if a dispute occurs one day. Second, obstacles in providing legal protection for geographical indications for Pandai Sikek Songket Weaving, namely, difficulties in compiling a book of geographical indication requirements, lack of public legal awareness of legal protection for geographical indications, as well as a lack of local government supervision regarding the potential for geographical indications for Songket Pandai Sikek.
