Pelaksanaan Wasiat Dondon Tua Menurut Hukum Adat Batak Toba Di Kelurahan Karo Kota Pematangsiantar
Dondon Tua is one way to obtain property, namely by having a will. The term dondon tua can be translated as "burdened with good fortune" so that the recipient will receive good things throughout their life. This term is applied to a will given to someone. Through this will, it is hoped that good luck will pass to the recipient. Such a will is full of good fortune, namely after carrying out an important ceremony which is the focal point of traditional activities. Problems occurred when the implementation of Dondon Tua's will was not carried out with the correct traditional ceremony, namely in the presence of Dalihan Na Tolu and Toba Batak traditional leaders. Dondon Tua is also not automatically part of the first male grandson of the first male child in the family, but must be by direct appointment from the donor of the assets.The purpose of writing this thesis is: first, to find out how the old dondon will is implemented according to Toba Batak customary law in Karo Village, Peamtangsiantar City. Second, to find out what the old dondon will looks like according to Toba Batak customary law in Karo Village, Pematangsiantar City.
The research method in this thesis uses a type of sociological legal research, namely research on the effectiveness of applicable law or research on legal identification. to see the unity between law and society with the gap between das sollen and das sein. A research approach that studies the influence of society on the law, the extent to which symptoms in society can influence the law. Interview with the Toba Batak Traditional Figure, Sintua/Raja Parhata and with the head of the clan association in Pematangsiantar City.
Based on the results of the research carried out, the following conclusions were obtained, namely: first, based on the theory of receptie which separates customary law and religious law, the system for granting old dondon wills is direct appointment. The first grandson of a man's first child to acquire the old dondon. If the family only has a granddaughter then she cannot be categorized as an old dondon recipient. Second, based on the theory of legal certainty, the process of giving dondon tua must be carried out in front of Toba Batak traditional leaders and most importantly in front of the dalihan na tolu because the validity of an oral will according to Toba Batak custom is in the presence of the dalihan na tolu and Toba Batak traditional leaders.
