Nowadays, when someone feels unwell, they go to a health service to have their condition checked. This is where the relationship between doctors, nurses, health care providers and patients arises, When carrying out medical procedures, doctors sometimes delegate their authority to nurses. The main problem in this research is to see how doctors are responsible for the delegation of authority given to nurses and see what efforts the patient can take if medical malpractice occurs to him.
This type of research is sociological legal research conducted in Taluk Kuantan City, specifically in Cerenti Klinik Pratama Harapan Bunda District, Kuantan Singingi Regency. Sources of data used are primary data and secondary data. Data collection techniques were carried out by interviews. The data were analyzed qualitatively, which produced descriptive data and concluded by a deductive method of thinking. The research results show that doctors are not responsible for delegation, while efforts that patients can take include legal mediation, reporting to health services, civil lawsuits and criminal charges.
The results of this research are that doctors are not responsible for medical negligence committed by nurses due to the limitations of doctors' responsibilities in delegation of authority. Doctors can be responsible for delegating the authority they are given if the nurses acts in accordance with the intructions given by the doctor or according to standard operating procedures (SOP) agreed upon by the doctor and nurses, in this case the nurse who committed medical negligence did not carry out the medical action in accordance with the stipulated SOP, and the doctor is not responsible in this case is the nurse on duty and the service facility healt workes who employ nurses in clinics, the efforts to resolve this problem are through dispute resolution outside of court through negotiation carried out by the clinic and the patients parent which is carried out twice.
