Users of electronic payment instruments have several risks that can occur when using electronic money on toll roads(e-toll) namely what was found at the Pekanbaru-Dumai toll gate, many consumers experienced losses from using illegible e-toll cards, damaged detection machines and errors in the class of vehicles used. Consumer Protection in article 4 letter H "Right to compensation, replacement loss and/or replacement, if the goods and/or services received are not in accordance with the agreement or are not as they should be." Meanwhile, the reality is that if damage occurs and the remaining balance is lost, it cannot be returned.
The research method in this thesis uses a type of sociological legal research, namely research on the effectiveness of law in society. The nature of this thesis research is researchdescriptivewhich systematically describes the facts and characteristics of the object being studied accurately. The data collection technique in this research is by interview, questionnaire and literature review methods, then after the data is collected it is then analyzed to draw conclusions.
From the research results, it was found that legal protection for consumers using e-tolls to pay for toll road use at the Pekanbaru-Dumai toll gate has not yet been implemented PT. Hakaaston (HKA)It is proven that the toll gate guard has not implemented consumer rights, because they did not provide clear information regarding the problems experienced, especially regarding the problem of faulty detection machines and incorrect detection of vehicle classes to users.e-toll. and there is no responsibility/action for compensation for the card balancee-toll which is reduced due to wrong group detection among consumers, obstacles and efforts in implementing useE-Toll At the Pekanbaru-Dumai Toll Gate, the first obstacle is a lack of balance. Efforts to deal with the problem of lack of balance. Usually when exiting the Pekanbaru Dumai Toll Road, the officer applies a balance to the user's card so that the user can still make payments viaE-toll, Second, the card cannot be reade-toll Then the next problem is in terms of cardse-toll damaged users, officers usually offer card replacements at a slightly cheaper price compared to the price of cards sold outside toll booths, when detecting the wrong type of vehicle, the effort in resolving this is that this compensation is also given in cash and cannot betop up directly on the user's carde-toll and a user error detection enginee-toll In this case, the card can pay in cash only if the machine is stuck or is being repaired.
