Tanggung Jawab Pt.Trison Nusantara Atas Wanprestasi Dalam Kontrak Kontruksi Renovasi Bangunan Kantor Pt.Pegadaian (Persero) Cabang Terandam Kota Padang
The existence of companies in Indonesia cannot be separated from their capacity as legal subjects involved in development in a country. This cannot be separated from the essence of development which is a process of change that takes place in a planned, conscious and sustainable manner. Therefore, development is the responsibility of all elements, including society, the private sector and government. PT. Trison Nusantara is one of the companies operating in the construction services sector in the city of Padang. PT. Trison Nusantara as one of the parties involved and involved in building renovation with the government as the project provider, one of which is PT. Pegadaian (Persero) Branch Terandam Padang City during the renovation of the office building. Office building renovation work is one example of work that has been submitted by PT. Pegadaian (Persero) Terandam Branch, Padang City to PT. Trison Nusantara in the context of construction services agreements. In the context of a construction services agreement in the form of building renovation between PT. Pegadaian Terandam Branch, Padang City and PT. Trison Nusantara, there are crucial issues that are interesting to research. The problem started with the renovation of PT Pegadaian's construction not being completed within the time period agreed between the two parties. Based on the results of field interviews conducted by researchers, the results of the SPI team's investigations in the field concluded that there were several types of work such as work space, customer, service and back office work that had not been renovated. Not only that, including the ceiling part that was not done properly. This information is strengthened by a statement letter from PT. Trison Nusantara through Letter Number 013/TRN-PDG/XII/2019 concerning Follow-up to the Inspection Results of the Renovation Work of the Terandam Branch Office Building in Padang City.
This research is classified as an empirical juridical research type, namely research on the effectiveness of law, how the law operates in society. This research was conducted in Padang City with the object being PT. Trison Nusantara and Pegadaian Branch were hit by Padang City. The data sources used are primary data and secondary data, data collection techniques in this research are interviews, questionnaires, literature review and data analysis.
From the results of the research carried out, several conclusions were obtained, namely: First, in fact PT. Trison Nusantara, in carrying out the renovation work on the pawnshop building, has completed 100% of the work on time. However, during the audit carried out by SPI (internal supervisory unit) which is part of Pegadaian, there were differences in the audit results where the volume of work carried out by PT. Trison Nusantara does not comply with the work volume agreed upon by both parties. Therefore PT. Trison Nusantara has actually committed a breach of contract in the form of carrying out its obligations but not in accordance with the agreed agreement. Second, PT. Trison Nusantara is responsible for the differences in audit results regarding the building renovation services of the Terandam Branch of Pegadaian, Padang City. PT. Trison Nusantara in completing its work is not in accordance with what is stated in the SPK between PT. Trison Nusantara with the Terandam Branch of Pegadaian in Padang City. Therefore, PT. Trison Nusantara is obliged to return the overpayment of the termyn that has been paid by Pegadaian and repair the work as appropriate. This is the responsibility of PT. Trison Nusantara regarding the breach of contract he committed.
