The constitution is all the provisions and basic rules regarding state administration, one of the functions of the constitution is the division of authority of each state institution. The provincial government in Indonesia is then divided into executive and legislative functions. The province is led by a governor. Then the province also has a legislative body, namely the Regional People's Representative Council (DPRD) for each province. One of the indicators of a democratic state is the holding of direct, free and secret elections to elect members of the people's representative institutions who will sit in Parliament or legislative institutions. From the provisions of Article 101 paragraph (1) of Law Number 23 Year 2014 concerning Regional Government, the Provincial DPRD has a function, one of which is the supervisory function.
This research uses normative legal research. Normative legal research is library legal research, namely legal research conducted by making library materials the main focus. The results showed that regulations on regional head regulations are regulated in Minister of Home Affairs Regulation Number 120 of 2018 concerning Amendments to Minister of Home Affairs Regulation Number 80 of 2015 concerning the Formation of Regional Legal Products. and Law Number 23 of 2014 concerning Regional Government. In the formation of governor regulations, there are mechanisms that are mandated by higher regulations and those formed based on the authority of the regional head. The Regional People's Representative Council (DPRD) of Riau Province has the authority to oversee the formation of governor regulations ordered by higher rules, while in governor regulations that are more related to autonomy functions, DPRD has no obligation or right to supervise both the ratification and implementation.
The ideal concept of regulation related to the supervision of regional head regulations considering that there are only general rules, it is necessary to make special rules related to this supervision. This technical supervision can be made by the Minister of Home Affairs or by the regions themselves, considering that the authority of the regions to regulate their own households has been legitimised through regional autonomy. In addition, technical regulations related to this supervision will strengthen the performance of the DPRD in legislation and supervision.
