ABSTRACT
According to Article 1457 of the Civil Code, a sale and purchase agreement is an agreement between a seller and a buyer in which the seller binds himself to transfer his ownership rights to an item to the buyer, and the buyer binds himself to pay the price of the item. One of the actions of the buyer that can harm the seller is such as frequent defaults, the actions of buyers who place orders and have been approved but when the order is complete the buyer cancels the order or does not make a transfer without any explanation from the buyer. In the implementation of the sale and purchase agreement at Optik Citra Pekanbaru, there are several buyers who make defaults, namely by not paying the bill and not taking orders that have been made previously so that the seller suffers losses for the buyer's actions. The sale and purchase agreement made at Oprik Citra is an oral agreement and a written agreement which makes the author interested in conducting this research. The purpose of this research is to be able to know and understand about the implementation of the sale and purchase agreement between the seller and the buyer who makes a default at Optik Citra Pekanbaru and to find out the form of default settlement between Optik Citra Pekanbaru as the seller and the buyer.
This research is a sociological legal research, namely research that looks at the relationship between law and society with the gap between the law that should and the law that actually occurs. The research was conducted at Optics Citra Pekanbaru City. This research also contains interviews and data obtained from owners and workers at Optik Citra Pekanbaru. Data collection techniques through interviews, observation and literature review.
From the results of the research that has been carried out, the sale and purchase agreement between the seller and the buyer at Optics Citra Pekanbaru is carried out orally and in writing. Oral agreements are when negotiating and agreeing on the items to be ordered and the price to be paid. The agreement in writing is when the buyer pays a down payment and the seller will make a payment note and the note explains the date when the goods are ready to be picked up and the remaining bills. But in reality, a number of buyers did not settle the bill and take the goods that had been ordered. The form of settlement carried out at Optik Citra is non-litigation or out of court and accepts a number of losses.
