Upaya Penyelesaian Sengketa Wanprestasi Kredit Usaha Rakyat (KUR) Tanpa Agunan (Studi Di PT. Pegadaian Cabang Syariah Ahmad Yani)

UMKM often need additional sources of financing to expand their business or even to stay in the industry. The government created the People's Business Credit (KUR) program, namely credit financing to help finance UMKM capital, which is implemented without collateral. However, in its implementation, KUR did not run smoothly. There are several credit problems experienced by Pegadaian Syariah Ahmad Yani Branch in implementing KUR. This research was conducted at one of the non-bank financial institutions, namely Pegadaian Syariah Ahmad Yani Pekanbaru Branch. The purpose of this research is to find out the factors that cause defaults by debtors and also to find out what efforts can be made by Pegadaian Syariah Ahmad Yani Branch to resolve them.
This type of research is sociological legal research or often called an empirical juridical approach by studying law as institutionalized patterns of social behavior. The focus of study in empirical legal research is how law works in society. Sociological legal research or empirical legal research obtains data from primary and secondary data sources. The data collection technique used in this research is using unstructured interview methods and literature review. This research uses a qualitative method, namely describing the data obtained in the form of regular, logical and effective sentences so that it can provide an explanation of the formulation of the problem being researched.
Results of the research that has been carried out, there are several external factors that cause default at Pegadaian Syariah Ahmad Yani Branch, namely declining sales factors and the need for debtors taking priority. Settlement efforts carried out by Pegadaian Syariah Ahmad Branch are through negotiation which is categorized as dispute resolution through non-litigation involving both parties making a joint agreement to resolve the problem.
