Tinjauan Hukum Terhadap Tindakan Rekayasa Dalam Penegakan Hukum Pidana Di Indonesia

Crime is an act that violates the law. In sociologically-based criminology, crime is a pattern of behavior that harms society and a pattern of behavior that gets a social reaction. The government has a responsibility in crime prevention efforts. According to Edwin Partogi, case engineering occurs due to neglect of the principles of management in criminal proceedings. There are several cases of engineering committed by the police in Yogyakarta who were allegedly wrongly arrested and committed violence that caused death, the case of arresting teenagers allegedly framed for buying methamphetamine in Binjai City, and the case of Ferdi Sambo who had engineered the premeditated murder of brigadier Yoshua. Cases of engineering in the form of criminalization or forced punishment are still rampant and revealed both at the level of investigation, investigation, especially in the examination process at the court level. The purpose of this research is to describe the reasons for the importance of regulating criminal engineering according to Indonesian positive law and to formulate the ideal idea of regulation regarding law enforcement against criminal engineering according to Indonesian positive law.
This research is normative juridical legal research. This normative research the author conducts research on legal principles, by first identifying the legal rules that have been formulated in certain legislation. This research uses data sources in the form of primary data and secondary data, and data collection techniques through literature review.
From the results of the research that has been conducted, there are two things that can be concluded. First, the urgency of the establishment of regulation of engineering actions in law enforcement that occur in Indonesia, among others, due to: lack of public confidence in the performance and integrity of law enforcement officials; low image of law enforcement officials; and decreased public awareness and legal compliance. Second, the regulation of sanctions that are quite severe, especially for law enforcement officers who commit case engineering, can be in the form of criminal, civil and administrative sanctions such as revocation of positions and so on and the regulation of compensation to be given to victims both for mental and material losses.
