ABSTRACT
Human Trafficking (TPPO) is a serious crime that violates human rights and is considered trafficking. Indonesia has a responsibility to combat TPPO. To address this, Indonesia has issued Law Number 21 of 2007 concerning the Eradication of Human Trafficking. According to Article 1 paragraph (1), Human Trafficking is defined as an act or series of acts that meet the elements of a crime as determined in this Law. One of the obstacles to the implementation of restitution in TPPO cases is providing a mechanism for victims to voice the impact of the crime they have experienced.
The purpose of this study is to analyze the legal protection provided to victims of human trafficking in the criminal justice system in Indonesia and the ideal concept of legal protection for victims of human trafficking in Indonesia in the future. The research method used is normative law with a regulatory approach (statutory approach) and a contextual approach (conceptual approach). The data sources obtained are based on primary, secondary and tertiary legal material data sources, with data collection based on library research. And the explanation uses a qualitative legal approach, which involves descriptive analysis.
The results of this study are Legal protection for victims of human trafficking in Indonesia is regulated in Law Number 21 of 2007 concerning the Eradication of the Crime of Human Trafficking which regulates the rights of victims and protection efforts that must be provided by the State, Law No. 1 of 2023 concerning the Criminal Code and other related regulations. The concept of ideal legal protection for victims of human trafficking in the future, namely protection for victims of human trafficking in Indonesia must provide guarantees of basic rights in accordance with human dignity, such as the right to safety, health, and social reintegration.
