ABSTRACT
This study discusses consumer protection against exaggerated claims in advertisements for skincare body lotion products at the Daviena store on Jalan Delima in Pekanbaru. The use of exaggerated claims is still commonly practiced by businesses in their product marketing. The discrepancy between claims and actual results can certainly harm consumers. This clearly violates Article 4 regarding consumer rights and Article 7 regarding the obligations of businesses, as stipulated in Law Number 8 of 1999 on Consumer Protection. Therefore, this study was conducted. First, to determine how consumer protection is applied regarding excessive claims in advertisements for skincare body lotion products at the Daviena store branch on Delima Street in Pekanbaru City. Second, to determine how businesses fulfill their obligations regarding skincare products in accordance with the provisions of the Consumer Protection Law.
This study is a sociological legal study, aiming to examine the correlation between law and society. Based on field research, which involves collecting data from interviews and literature reviews related to this study, and using qualitative data analysis, descriptive data was generated and concluded using deductive reasoning.
From the interview results, it was found that exaggerated claims in advertisements for skincare body lotion products at the Daviena store on Delima Street in Pekanbaru City cause losses for consumers. Consumers experienced both material and immaterial losses. Material losses included spending a significant amount of money on products that did not deliver results as promised. Immaterial losses included feelings of disappointment and dissatisfaction because consumers had placed their hopes in the products they purchased. From the results of this study, it can be concluded that, first, consumer protection against excessive claims in advertisements for skincare body lotion products at the Daviena store branch on Delima Street in Pekanbaru City has not been implemented optimally. The use of excessive claims in advertisements for skincare product marketing can create unrealistic expectations and result in losses for consumers. Supervision by the government and consumer legal awareness are also still relatively low. Second, business actors have not fully carried out their obligations in accordance with consumer protection laws. Business actors use marketing strategies that tend to be misleading in order to increase sales without regard for consumer rights. They also do not prioritize the principle of good faith in conducting their business activities.
