Under the mandate of Article 34 paragraph (1) of the Constitution Year 1945, then formed the Law Number 13 Year 2011 about Poverty Management which regulates the rights of the poor. However, the poor people in the city of Pekanbaru live with the limitations of their basic needs.
Based on this understanding, the authors formulate three formulations of the problems, namely: The first, What is the legal protection of the poor based on Law Number 13 Year 2011 on Poverty Management? Second, What are the factors inhibiting unfulfilled legal protection of the rights of the poor are guaranteed to Law Number 13 Year 2011 on Poverty Management in Pekanbaru? Third, How is Social Service efforts and order fulfillment Pekanbaru City Cemetery legal protection of the rights of the poor are guaranteed to Law Number 13 Year 2011 on Poverty Management in Pekanbaru?
This type of research can be classified into types of juridical sociological research, by conducting direct research to the study site. Sources of data used in this study are primary data, secondary data, and the data tertiary. Data collection techniques in this study are the interviews, questionnaires, and literature study. The data analysis in this study is the qualitative analysis using the deductive method.
From the research, there are three main problems that can be inferred. First, The legal protection of the poor legal protection based on Law Number 13 Year 2011 on Poverty Management in Pekanbaru is the responsibility of the Department of Social and Pekanbaru City Cemetery. However, the legal protection of the poor have not been fulfilled to the fullest. Social Service and Funeral Pekanbaru is still not able to give legal protection to the fulfillment of the rights of the poor and needy in the city of Pekanbaru as has been stipulated in the Law No. 13 Year 2011 on Poverty Management in Pekanbaru. Second, factors inhibiting unfulfilled legal protection of the rights of the poor and needy in the city of Pekanbaru is guaranteed Act No. 13 of 2011 on Poverty Management in Pekanbaru City is not the program needs clothing, bureaucratic authority, and some constraints. Third, Social Service efforts and order fulfillment Pekanbaru City Cemetery legal protection of the rights of the poor are guaranteed to Law Number 13 Year 2011 on Poverty Management in Pekanbaru.
