Position Report on the Regional Head in local governance is incumbent regional heads submitted to Parliament at the end of each year and the term of office by a certain mechanism. Nevertheless, the obligation Report on the Regional Head does not have legal consequences against the dismissal of the Head of Region as contained in Law No. 32 of 2004 on Regional Government. Constraints related judicial accountability report to the Regional Head of Parliament based on Law Number 32 Year 2004 regarding Regional Head namely the lack of strict sanctions against the delay in the implementation of the accountability report, there is no clear legal consequence of the poor performance of the Regional Head achievement in accountability report, and the lack of accountability mechanisms transparency and accountability report for the community. Based on this understanding, this thesis formulates the two formulation of the problem, namely: First, How is the position of head of the Accountability Report on Regions To the Legislative Council pursuant to Act No. 32 of 2004 on Regional Government? Second, What are the constraints related to the juridical status Remarks Accountability Report to the Regional Head of the Legislative Council pursuant to Act No. 32 of 2004 on Regional Government?
The research method in this study, first, the type of research is a descriptive and normative legal analysis. Second, the data sources, supported by the primary data source, secondary data sources and tertiary data sources. Third, the data collection techniques used are literature studies. After the data collected was then analyzed qualitatively, and then draw conclusions with deductive method of thinking is to analyze the problems of the general form into specific shapes.
From the research, there are two main problems that can be concluded, first, the Status Report on the Regional Head accountability report in local governance is the duty of the regional heads submitted to Parliament at the end of each year of his tenure and accountability report. Second, related Legally accountability report to the Regional Head of Parliament based on Law Number 32 Year 2004 regarding Regional Head ie no strict sanctions against the delay in the implementation of the accountability report, and there is no clear legal consequence of the poor performance of the Regional Head achievement in accountability report, Constraints another challenge facing the implementation of accountability and transparency in Local Government accountability is that under Article 12 of Government Regulation No. 3 of 2007 determined that the Regional Head evaluating LPPD District Municipality. So that accountability and transparency mechanisms Regional Head accountability report is not able to respond to the aspirations of its people.
