Work agreement is devided into Work Agreement of Specific Time (PKWT) and work agreement unspecified time (PKWTT). Casual laborers are part of Agreement of Specific Time (PKWT) accordance with the provisions in Regulations the Law number 13 of 2003 about Manpower. Department of Hygiene and Pekanbaru City has a janitor who is a casual laborers with the statement of work. The janitor working system that works every day and do not get time off the rest weekly. The purpose of this thesis, namely; Knowing the implementation of the legal protection of the rights of the working week break granted for casual laborers as a janitor and barriers faced by the Department of Hygiene and Pekanbaru City in the implementation of the legal protection of the right to break the weekly work meeting the rights of non-permanent employees as a janitor in Department of Hygiene and Pekanbaru City.
This type of research is classified into types of sociological research, ie research on the effectiveness of the law in force, the nature of this research is descriptive research that describe systematically the facts and characteristics of the object under study is appropriate This research was conducted in The road Datuk Maharaja Setia Pekanbaru while the overall population and the sample is related to the problems examined in this study, which used data sources, primary data and secondary data consisting of primary legal materials, secondary and tertiary, collection techniques data in this study with questionnaires, interviews and literature study and analysis of the data used is the qualitative analysis is based on the description sentences and draw conclusions deductively, from the general to the specific.
From the research, there are two main problems that can be inferred. First, Implementation of the legal protection of a Department of Hygiene and Pekanbaru City weekly rest is not done right. Secondly, Obstacles encountered in the implementation of legal protection for the city janitor and landscaper pekanbaru divided into two internal factors that employment agreement, the city needs pekanbaru and lack Fund Budget, while external factors ie Weak supervision of the Department of Manpower and Transmigration and the absence of affirmation sanctions. Advice author, Implementation legal protection of weekly work breaks more attention and improved, as well as the need for the role of the Department of Manpower and Transmigration both preventive and repressive nature. Secondly, it is reviewing the statement of work, the need for new work systems that leave the weekly schedule is not the same workers, the need for cooperation on the cleanliness of the city, and the active role of the Department of Manpower and Transmigration.
