Indirect evidence bid rigging cases in unfair competition is needed as evidence in court. indirect evidence shall have the force of law and regulation in the law of civil procedure / HIR or RBg thus recognized by civil procedural law in Indonesia. Indirect evidence is governed by Article 164 HIR / RBg and in Article 1866 of the Civil Code. Article 164 and 1866 of the Civil Code HIR evidence is not directly located on suspicions that Judge suspicions, assumptions, guesswork and logic while Article 42 of Law No. 5 of 1999 is situated in the destination.
The purpose of writing this thesis are: First, to determine the position of the tool indirect evidence in the proof by HIR / RBg, second, to determine the legal power tools indirect evidence cases of bid rigging in unfair competition.This research is a normative legal research or can be also called the doctrinal legal research. From the research problem there are two principal concluded, first, Tool circumstantial evidence (indirect evidence) can be used as evidence categorized as evidence in a civil case in particular competition cases Usha unhealthy located on conjecture (conjecture judges), which also is based on allegations , interpretation or interpretation and logic as well as the instructions set out in Article 173 HIR, 1922 Civil Code and Article 42 Undag Legal Prohibition of Monopolistic Practices and Unfair Business Competition. Second, Strength evidentiary tool circumstantial evidence (indirect evidence) cases of bid rigging in unfair competition lies in Article Article 164 HIR and 1922 of the Civil Code is the conjecture (conjecture judges) and Article 42 of the Law on Prohibition of Monopolistic Practices and Unfair Business Competition namely in the instructions. So indirect evidence (indirect evidence) can be used in case of bid rigging.
