Karakteristik Sistem Parlementer Dalam Sistem Pemerintahan Di Indonesia Pasca Amandemen Undang-Undang Dasar Negara Republik Indonesia Tahun 1945
Form of government system is generally divided into two, namely the
system of parliamentary and presidential system of government. To determine the
system of government of a country seen through the mission of the constitution of
each country. Based on the Law of the Republic of Indonesia Year 1945 (UUD
1945) after the general amndemen Indonesian government system directs the
Presidential system of government. Improvement of the system of government
after the 1945 amendment meets the basic principles of the presidential system
has been attempted. However there are still some phenomena in the life of the
state is likely to lead to parliamentary. So in some ways the executive policy, the
president can not run the government fully as much about strategic policies that
must be taken together with Parliament, the writer of this thesis formulated two
formulation of the problem, namely: First, how the characteristics of a
parliamentary system of the government system in Indonesia post amendments to
the Constitution of the Republic of Indonesia Year 1945? Second, does it imply the
characteristics of a parliamentary system of the government system in Indonesia
after the amendment of the Constitution of the Republic of Indonesia in the state
administration in Indonesia?
The research method in this study. Types of legal writing normative and
descriptive analysis. Sources of data in this research study law of the primary
data, secondary data, and the data tertiary. The data collection technique used
was the study of literature. After the data collected then analyzed qualitatively,
and concludes with the deductive method of thinking which was to draw
conclusions the general HSL arrives to the things that are special.
The conclusions in this research, in general, the Indonesian government
system after the amendment in 1945 led to a presidential system. There are still
some chapters that lead to the characteristics of parliamentary system of
government, such as; Article 11 Paragraph (1), Article 11 Paragraph (2), Article
13 Paragraph (2), Article 14 paragraph (2), Article 24A Paragraph (3), Article
24B Paragraph (3) of these chapters shows that the effect legislature in every
strategic decision the state is still very strong, the legislature, influenced the
decision of the executive. Secondly, the implications of the characteristics of a
parliamentary system of the government system in Indonesia after the amendment
ie executive positions at once can only be weakened if some discretion is strongly
influenced by the approval and legislative considerations, so it does not run the
checks and balances which is expected as it should. Based on this, it should be a
system of government in Indonesia with a presidential system of government is not
to dominate, but the position of the parliament is a balancing supervisor and the
proposer.
