Pertanggungjawaban Pidana Terhadap Tindak Pidana Korupsi Kredit Fiktif Berdasarkan Undang - Undang Nomor 31 Tahun 1999 Jo. Undang -Undang Nomor 20 Tahun 2001 Tentang Pemberantasan Tindak Pidana Korupsi
Corruption can take place anywhere, not only in government but in state owned banks can also occur. Non perfoming loans in turn be solved through civil law. But not perfoming loans wich begins in a prolonged procedure in the withdrawal of their loans such as fictitious credit must be held accountable for criminal liability. Fictitious credit that occurs in state owned banks has been categorized as a criminal act of corruption because there is an element of intent from the beginning to make loans to the detriment of the country’s finances, to do unlawful acts and benefits themselves. The act is not only done by the recipient of funds alone, but bank employees as lenders participate in the occurrence of state losses. The purposeof this thesis, namely; First, to find out how criminal liability for corruption is related to fictitious credit under Law No.31 of 1999 Jo. Law No. 20 of 2001 concerning Eradication of Corruption Crime.
From the results of the study, based on two problem formulations can be concluded. First, criminal liability for fictitious credit corruption acts is liability for criminal acts committed by perpetrator. Fictitious credit corruption committed must fulfill the elements determined by the law. Someone will be held accountable for these actions if there is an element of unlawful acts, harms the country's finances and benefits oneself or others based on Law No.31 of 1999 Jo. Law No. 20 of 2001 concerning Eradication of Corruption Crimes. Second, the application of the law of deelneming (inclusion) in fictitious credit corruption in banks based on Act No.31 of 1999 jo. Law No. 20 of 2001 concerning the Eradication of Criminal Acts of Corruption is as a basis for extending the conviction of people involved in the realization of offense. The application of the teaching of inclusion to the eradication of corruption in Indonesia based on Article 55 paragraph (1) is applied to material perpetrators who commit corrupt or incomplete or imperfect acts. Material actors who are customers and bank employees who have the authority to disburse a loan together commit fictitious credit corruption.
