Along with the implementation of regional autonomy, the development and development of the region in the Regency / City is very rapid, marked by the division of the district, the emergence of new regions, the opening of isolated areas, and the rapid development of infrastructure. This condition causes the existing spatial planning and regional planning policies to be violated frequently. As a result, there is clutter in land use and regional development, and ineffective positions of strategic environmental studies as a form of strategic action in demanding, directing and guaranteeing no negative effects on the environment and sustainability, considered inherently in policies, plans and programs (KRP).
Regional Regulation Number 10 of 2018 concerning Spatial Planning for Riau Province 2018-2038 is formally and materially flawed. The publishing process is imposed by a handful of elites and entrepreneurs, placing more importance on the economic aspects of the elite and entrepreneurs than on protecting the ecological space and the management of indigenous and local communities. To find out the urgency of the Strategic Environmental Study the researcher poured in the form of a thesis writing with the first problem formulation, how was the urgency of the Strategic Environmental Study in the Formation of a Regional Spatial Plan ?. Second, is the formation of Regional Regulation Number 10 of 2018 concerning Riau Province Spatial Planning 2018-2038 in accordance with the applicable laws and regulations? Third, what is the legal consequence of the absence of a Strategic Environmental Assessment in the Formation of a Regional Spatial Plan?
The research method used by the author is a normative legal research study of legal systematics, because it discusses and examines Regional Regulation Number 10 of 2018 concerning Spatial Planning for Riau Province 2018-2038 whose stipulations are not in accordance with higher laws and regulations. In this study, researchers will collect data consisting of primary data and secondary data. Data collection techniques, namely interviews and literature review. Data analysis was carried out qualitatively and drawing conclusions from the author using deductive thinking methods.
The conclusion from the results of this study is that the urgency of a strategic environmental study in the formation of a regional spatial plan is to ensure that the principles of sustainable development have been considered in the contents of the 2017-2037 Provincial RTRW, assessing the influence of the PPP as stipulated in the 2017-2037 Provincial RTRW Draft Regulation , formulating options for mitigating impacts and / or alternatives for the 2017-2037 Provincial RTRW Regional Regulation draft Regional Regulation and ensuring the participation of the community and other stakeholders in spatial policy decision making. Secondly, the formation of Regional Regulation Number 10 of 2018 concerning the Spatial Planning of Riau Province 2018-2038 is not in accordance with the applicable laws and regulations, including in contradiction with Law Number 26 of 2007 concerning Spatial Planning, Law Number 32 of 2009 Concerning Environmental Protection and Management, Government Regulation Number 46 of 2016 concerning Procedures for Conducting Strategic Environmental Studies, Regulation of the Minister of Home Affairs Number 80 of 2015 Regarding Formation of Regional Legal Products and Decree of the Minister of Home Affairs Number 188.34-9552 of 2017. Third, due to the law of the absence of a Strategic Environmental Assessment in the Formation of a Regional Spatial Plan is to cause the Regional Regulation to be formally flawed and materially flawed. Formally means imperfection of substance from Regional Regulation Number 10 of 2018 concerning Spatial Planning for Riau Province 2018-2038 and materially means imperfection of content or content of Regional Regulation Number 10 of 2018 concerning Spatial Planning of Riau Province 2018-2038.
