Tanggung Jawab Perawat Dalam Melakukan Tindakan Medis (Injeksi Vitamin C) Di Luar Jam Kerja Di Kabupaten Siak Sri Indrapura
ABSTRCT Nurses are the most health workers in Indonesia. Nursing staff who perform nursing actions must be in accordance with nurse competencies that have been established and obtained during the education process. Therefore, the legal responsibility of a nurse in carrying out nursing practice must be in accordance with nurse service standards, professional standards, operational standards and health needs of recipients of health services. The purpose of writing this thesis, namely: First To find out what is the Nurse's responsibility for medical actions outside working hours. Second To find out the efforts that must be done by patients against nurses' mistakes in carrying out medical actions outside working hours This type of research belongs to the Sociological Juridical research. According to Sutrisno Hadi, Sociological Juridical research is an effort to determine, develop, and test the truth of business knowledge carried out using scientific methods for the research. This research was conducted and to complete the data source, the authors conducted research in Siak Sri Indrapura Regency, the data used were primary data, secondary data and data collection techniques in the form of research with interviews and questionnaires. From the results of this study it can be concluded that, First, the Nurse's Responsibility for the medical actions he committed, for negligence carried out, nurses X should first obtain the delegation of authority from the Doctor as stipulated in article 29 of Law Number 38 Year 2014 Concerning Nursing , and based on Law Number 36 Year 2014 Regarding Health Workers Article 68 also explains that '' Every individual health service action carried out by health workers must obtain approval. Then the error of medical action carried out by the Nurse without any delegation of authority verbally or in writing from the doctor should be the responsibility borne by the Nurse as a result of medical negligence without any delegation of authority he obtained. Second, legal remedies that can be done by patients against nurses' mistakes outside working hours. Patients receive legal protection, which is based on Law Number 36 of 2014 concerning Health Workers in Article 77, there are several stages that can be done by patients if the patient suffers a loss of medical action carried out by the Nurse ie the patient can complain the Nurse concerned to the DPK where the nurse is in the next shelter if the DPK is unable to cope with it the patient can complain to the DPD Nursing and Decide with the decision of the DPW of nursing for appropriate sanctions against the Nurse concerned .
