ABSTRACT
Gold Pawn is one of the BRI Syariah Bank products which is included in the category of financing based on al-qardh (giving), the funds must be returned by the customer to the bank at once or to installments until the due date and be implemented by applying the prudent bankking principle) as well as the principle of getting to know customers. In practice, in the procedure for settlement of collateral items due at BRI Syariah Bank, contact the Customers whose loan period is due, the 4th day after the maturity of the loan. Purpose Writing this thesis, namely: First, to find out the procedure for auctioning the object of the gold pawning agreement between customers and BRI Syariah Bank Pekanbaru Branch. Second, to find out the legal protection of customers auctioning a gold pawning agreement object at BRI Syariah Bank PekanbaruBranch.
This type of research can be classified as a type of sociological legal research, because in this study the authors directly conduct research at the location or places that are examined to provide a complete and clear picture of the problem under study. This research was conducted at BRI Syariah Bank Pekanbaru Branch, while the population and sample were all sections related to this research, the data sources used were primary data, secondary data and tertiary data, data collection techniques, namely interviews and literaturestudies.
From the results of the research and discussion it can be concluded that, in the process of implementing the BRI Syariah pawn agreement there are four stages, namely the first stage is the request where the customer fills out a financing request form as a process of customer self-identity. The second stage is the gold assessment process, which in this assessment process aims to obtain the estimated value of the gold, the aim is to obtain the amount of financing that will be provided to the customer. The third stage of determining the period of time that aims to determine the period of the repayment process in financing the mortgage. And the fourth stage in the implementation of this pawning agreement is the issuance of BRI Syariah pawn which in this letter regulates the terms of the contract contained in the process of executing the pawning agreement. The problem lies in taking or notifying the gold pawnshop expiration date, and also in the auction conducted outside the auction body. The legal protection of customers as consumers is listed in the Civil Code in Article 1155 which states that collateral goods auctioned will be auctioned in public and in accordance with applicable regulations so as not to cause harm to the customer.
