Eksistensi Hukum Adat Minangkabau Dalam Menyelesaikan Tindak Pidana Penculikan Gadis Di Talu Pasaman Barat
Indonesia is a country based on law. In social life, in addition to the
existence of national laws, there are also customary laws that are born out of
developing habits and behavior. Customary law is still implemented especially in
the West Talu Pasaman region where the community still uses customary criminal
law to resolve the crime of kidnapping girls. The purpose of writing this thesis,
namely: knowing the forms of customary criminal acts whose settlement is left to
customary law Minang. Know the form of settlement of the crime of kidnapping
girls according to Minang customary law in Talu Pasaman Barat. And know how
far the binding power of the Minang customary law decision in resolving the
crime of kidnapping girls in Talu Pasaman Barat
The author uses sociological research methods in Talu, Talamau District,
West Pasaman Regency, West Sumatra Province. Population and sample are all
parties related to the problem examined in this study, data sources used are
primary data, secondary data, and tertiary data, data collection techniques in this
study with interviews and document studies.
Based on the results of research and discussion that: The form of
customary criminal acts which the settlement is handed over to the Minangkabau
customary law (stab-kill, upas-poison, samun-sakar, siar-bakar, thief, thief, dagodagi,
discordant-wrong). The form of the settlement of the crime of kidnapping
girls in Talu is done through customary deliberations. The binding power of the
Minangkabau adat law decisions in Talu Pasaman Barat is still very strong as
evidenced by the deterrent effect arising from the verdicts handed down.
The conclusion that can be drawn from this research is that there are
several types of criminal acts which are resolved in Minangkabau customary law.
The kidnapping case against a girl that occurred in Talu Pasaman Barat was
resolved through a community consultation. And the binding power of
Minangkabau adat law decisions in West Talu Pasaman is still very strong in
obeying and having a good impact on the people in West Talu Pasaman.
Based on the description above, the writer's suggestion is: it is better that
between the police and the customary community there be cooperation in
resolving cases of customary criminal acts, so that the mamak niniak stiffness in
giving a sentence that harms the perpetrator is protected in the future because
kidnapping is also regulated in Indonesian positive law, besides that the writer
also suggested to the mamak niniak to further maximize their role in running the
adat court.
