Kebijakan Formulasi Bullying Sebagai Tindak Pidana Dikaitkan Dengan Perlindugan Hukum Bagi Korban

One violation of the that often occurs in Indonesia is bullying, especially
among adolescents. Cases of bullying usually affect students or school children.
Bullying perpetrators will intimidate / insult his friend so that his friend is
annoyed. The more severe negative impact is, victims of bullying will experience
depression and until they feel suicidal. Bullying must be avoided because bullying
results in the victim thinking of not going to school because at school he will be
bullied by the offender. In addition, bullying can also make a child go down
because he feels pressured often bullied by the perpetrators.
This type of research can be classified in the type of Normative legal
research, which reveals legislation relating to legal theories that are the object of
research. The approach taken uses a qualitative analysis approach by looking for
data both in books, journals and other scientific works related to this research.
The data sources used are primary and secondary legal materials.
The conclusions that can be obtained from the results of the study are
First, the regulation of bullying oppression which results in mental shock or to
death of children in Indonesian criminal law in the present condition. At present
conditions bullying which results in death of children is very serious impact
among children in Indonesia, due to lack of control or supervision from the family
as well as in the school environment and other neighborhoods. Lately in the
media and newspapers are very crowded or rampant cases of bullying that occur
in children, this seems to be a frightening specter in society. Second, the idea of
regulating bullying crimes that result in death in children for cases in the future.
Not yet running a rule will be a crime of bullying which results in death of
children, causing many problems or losses experienced by children including the
nation and state. The need for legal certainty is also related to the existence of
regulations and their implementation. Legal certainty will direct the community to
determine positive law on state law that has been determined. With the principle
of legal certainty, the community can be calmer and will not avoid difficulties
because of others.
