State Logistics Agency has implemented a Rice Sale and
Purchase Agreement (PJB) with its partner, the Al Falah Trade Business. One
form of negligence or broken promises in the implementation of the agreement
that can be said to be detrimental to one party is the problem of default. The
purpose of writing this thesis is to find out the factors causing the breach of
default by the Banyumas Bulog Corporation with the Al Falah Trade Business
and efforts to resolve the breach of contract in the implementation of the rice sale
and purchase agreement.
This research is a sociological research which is a type of research that
uses the assumptions of the community in searching for facts that occur in the
field to answer a problem that exists. This research was carried out in the area of
the Public Corporation Logistics Agency Regional Division Region IV Banyumas.
While the population and sample are parties related to the problem examined in
this study, the source of the data used, primary data, secondary data, and tertiary
data. Data collection techniques in this study were interviews and literature
review.
From the results of the research that the author did, it can be concluded
that in the sale and purchase agreement of rice there arises a breach of default by
the Al Falah Trade Business against the Banyumas Bulog Corporation where the
Al Falah Trading Business cannot submit the object of the agreement in the form
of rice during the contract period according to the agreed time so it is too late to
hand over agreement object. Then, the Al Falah Trading Business cannot deliver
milled rice according to standards. The factors that caused the default were due
to rising public market prices, lack of operational funds, low yields, and damage
to survey machinery and / or equipment. Efforts to resolve the default occurence
of giving an extension of time to the Al Falah Trade Business to meet its
achievements, imposing sanctions in the form of claims for late delay in the
extension period, the settlement is carried out internally through the Internal
Supervisory Unit (SPI) owned by the Banyumas Bulog Corporation.
