Pelaksanaan Persetujuan Medik (Informed Consent) Dalam Pelayanan Radiologi Di Rumah Sakit Islam Ibnu Sina
Health problems can involve all aspects of life and cover the entire time of
human life. Doctors, patients and hospitals are the three legal subjects involved in
the field of health care. The implementation of the relationship between the three is
always governed by certain rules so that harmony occurs in carrying out the
relationship. The medical action taken by the nurse against the patient will backfire
when the action is detrimental to the patient, while the action is an oversight of the
tasks that should be performed by the doctor. There are still many among health
workers who do x-rays without the consent of the doctor with an urgent reason that is
the background of a health worker doing radiology techniques without the approval
of the doctor. From this background, the formulation of the problem was born,
namely, first how is the protection of patients related to health workers in conducting
radiology techniques without the consent of the doctor from the perspective of civil
law? Second, is there a civil law action against the actions of health workers without
the approval of a doctor? The purpose of this thesis is to find out the responsibilities
of health workers in conducting radiology techniques without the approval of a
doctor and to find out legal efforts are given to health workers in conducting
radiology techniques without the consent of the doctor.
This type of research can be classified with research classified into sociological
juridical research where this study examines the synchronization of the law.From the
results of the study found that, first based on the Regulation of the Minister of Health
of the Republic of Indonesia Number 290 Year 2008 Regarding the Approval of
Medical Measures, after the patient gets information from a doctor or health worker,
because the patient will decide to give or refuse consent for the action to himself but
has not been carried out with good even impressed not serious and ignored. Second,
legal remedies against the actions of health workers without the consent of the doctor
is to provide a solution in the form of a mediation mechanism for the community /
patients who feel disadvantaged over the negligence of health workers including in
providing services. The mediation mechanism is a choice for dispute resolution (nonlitigation).
The reason is, someone is allowed to take another legal route (litigation)
for example through a civil route in the form of a claim for compensation.
