Cooperatives are built to create business and services in creating kinship
principles, cooperative efforts are businesses that are in accordance with
economic democracy, because in economic democracy there are elements of
cooperative effort. Savings and Loans Cooperatives and Savings and Loans Units
in their current development for fundraising activities are not only collecting
funds from cooperative members, but also for prospective members who are not in
accordance with applicable regulations. funds directly from the community.
Where those who can raise funds directly from the public are banking legal
entities. The purpose of writing the thesis is: first, to determine the
implementation and obstacles in the activity of raising funds for prospective
cooperative members by the Swamitra Savings and Loan Unit of the Sail Jaya
Cooperative. And second, to find out the responsibility of the Sail Jaya
Cooperative Swamitra Savings and Loan Unit for raising funds for prospective
cooperative members
The research method of this thesis uses a type of sociological legal
research, research which is carried out by conducting legal identification and
how the effectiveness of the law applies in society. This research is descriptive.
Sources of data used are primary data and secondary data, which consists of
primary legal materials, secondary legal materials, and tertiary legal materials,
data collection techniques in this study are interview methods, and literature
review, after the data is collected then analyzed to draw conclusions.
From the results of the research and discussion, it can be concluded first
that, the implementation of activities to raise funds for prospective cooperative
members by the Sail Jaya Cooperative Swamitra Savings and Loan Unit is not
running properly or not in accordance with applicable regulations. USP
Swamitra Koperasi Sail Jaya focuses more on business activities to provide loans
or credit to members and / or prospective members of cooperatives because the
business activities are more profitable. And the lack of understanding for
prospective members of the cooperative itself about USP Swamitra and both
about its rights and obligations. So that there is a need for legal responsibility
given by the cooperative and there is firm action from the government from the
Pekanbaru City Cooperative Office.
