The authority of the central government which regulates the control,
ownership, use and utilization of land and natural resources in a sectoral,
authoritarian, and centralism in granting licenses to exploit natural resources to
business entities causes 3 (three) main problems that is inequality of land tenure,
agrarian conflicts in natural resource management, and environmental damage.
In 2018, the President Republic of Indonesia issued Presidential Regulation
Number 86 about Agrarian Reform, where in article 2 Chapter 2 states that
Agrarian Reform aims to reduce imbalance in land tenure and ownership in order
to create justice; handling agrarian disputes and conflicts; creating an agrarianbased
source of prosperity and community welfare through tenure arrangements,
ownership, use and utilization of land; creating jobs to reduce poverty; improve
public access to economic resources; increasing food security and sovereignty;
and improve and maintain the quality of environment.
Following up on Presidential Regulation Number 86, in 2018 at Riau
Province, precise in Siak Regency, The government implements land
redistribution ex-concession area (HGU) of PT. Mahakarya Eka Guna (MEG) for
the community through the TORA program (the land objected of agrarian reform)
in order to rearrange the inequality of the structure of control, ownership, land
use and utilization towards a more just. So that land can be a source of livelihood
and welfare for the community. The land that was distributed to the community
for agriculture came from the release of entire PT. MEG concession.
The plantation business license was not issued for the company, due to the
existence of the Presidential Instruction on peatland moratorium (INPRES RI
No.8 of 2015 about Postponement of Granting New Permits and Improving
Management of Primary Natural Forests and Peatlands) and Presidential
Instruction on Palm Oil Moratorium (INPRES No. 8 of 2018 about Postponement
and Evaluation of Palm Oil Plantation Licenses and Increasing Productivity of
Palm Oil Plantations), where is the requested location most of them are in the
function area of peat swamp ecosystem the Ministry of Environment and Forestry
(KLHK) with a depth of more than 3 meters, so that peatlands management must
follow government regulations regarding of function area.
The land for TORA program dominated by very deep peat. The condition
is currently being carried out by land clearing for immediate land use.
Meanwhile, the community does not have enough information and knowledge
about land management and the most profitable crop choices on peatlands.
Therefore, it is important to conduct an ecological social study and economics in
managing the peatlands of ex-concession area for the sustainability of community
welfare while maintaining the function of the peat swamp ecosystem.
This research uses an exploratory approach, researchers try to dig up
information, describe or know how about condition and potential of ecology and
socio-economic conditions of community on the peatlands of ex-concession

corporate area. Collecting data was carried out by survey and interview methods
to got primary data and secondary data. Primary data is obtained through
interviews, observation, and documentation, while secondary data from literature
and related agencies within Siak Regency Government. Total samples interviewed
was 15 people consisting of the Government, the community, and environmental
organizations by using purposive sampling technique based on predetermined
criteria to obtain a representative sample.
From the research results, in the general community accept the TORA
program by Siak Regency Government but the plot (persil) location resulted from
the distribution of land with random conditions causing difficulties in managing
TORA land individually. So that the community hopes that its management can be
done together and assisted by the government. The condition of peatlands exconcession
corporate area in Sungai Berbari and Sungai Limau villages has the
potential to be developed for cultivation areas. Strategy of community-based
peatlands management in ex-concession area is as follows: (a) Assistance by Siak
Regency Government in an effort to reduce forest and land fires due to land
clearing, (b) Provide training and outreach to the community about agriculture
that has economic value in Agricultural crops, plantation crops, and timber
crops, (c) Land management uses village funds through a mechanism of equity
participation by the Village Government to BUMKam (Village-owned enterprises)
or collaboration with a third party that facilitated by Siak Regency Government,
(d) Forming a unit under the shade of BUMKam with a business entity in the form
of cooperative with commodities agreed upon by community and with guarantee
of community land certificates.
