ABSTRACT
Article 1313 BW provides a formulation of "a contract or agreement,
an agreement is an act whereby one or more people bind themselves to one or
more other people. The occurrence of tenant defaults with the Market
management, which in statement points number eight and ten reads
prohibited from selling, buying, renting and lending booths, kiosks or
temporary places to other parties. The objectives of this study are first, to
determine the causes of default in the oral agreement between traders and
market managers in Pasar Baru Pangkalan Kerinci, Pelalawan Regency.
Second, to find out the efforts to resolve defaults on the oral rental agreement
to rent a kiosk and Los between traders and the manager of Pasar Baru
Pangkalan Kerinci, Pelalawan Regency.
This type of research is sociological research, because the author
directly conducts research at the location of the place under study in order to
provide a complete and clear picture of the problem under study.
The results of the research and discussion show that first, the
occurrence of default in Pasar Baru Pangkalan Kerinci between traders and
market managers who defaults or breaks promises and statements of
negligence in accordance with article 1238 of the Civil Code. Second, how to
solve the problem by using the Negotiation route. Third, the result of the
agreement that occurred was the re-confiscation of kiosks and booths where
the tenant failed to perform and even there was compensation. Meanwhile,
efforts to overcome default are only in the form of statements. In the rental
agreement for renting booths and kiosks at Pasar Baru Pangkalan Kerinci,
Pelalawan Regency, there should be a written agreement not just a statement
and more stressed on the related articles. The creditor or the lessee is even
more assertive in carrying out the contents of the agreement and taking
action against the debtor who violates the agreement which is in accordance
with the law and applies a comprehensive compensation system. In order to
provide a deterrent effect for debtors who are in default.
