ABSTRACT
An auction is a sale of goods open to the public, either directly or through
electronic media, by means of verbal and / or written price bidding preceded by
an effort to gather interested people, which ends with the issuance of the auction
minutes. the minutes of the auction can be used as the perfect piece of evidence
for the parties. Auction minutes provide a guarantee of legal certainty for the
parties, because the minutes of auction are the authentic deed of the purchase of
an item through the auction process.
The purpose of writing this thesis is: first, to find out the
implementationlegal protection of the auction winner without auction minutes,
second, to find out the legal consequences that occur from the auction winner
without auction minutes. This type of research is included in Sociological
Juridical Research. According to Soerjono Soekanto, Socio-logical juridical
research is secondary data which is then followed by research on primary data in
the field or on the community. Efforts are made by using the scientific method for
research. This research was conducted and to complete the data source, the
authors conducted this research at PT.Ibid Balai Lelang Pekanbaru City, the data
used are primary data, secondary data and data collection techniques in the form
of research by interview.
From the results of this research it can be concluded that the Minutes of
the Auction will be given a copy to the seller and a quote to the Buyer / Auction
Winner. The Minutes of Auction Deed are often poorly understood by both the
seller and the buyer in terms of enforceability, as well as its strength for everyone
who owns it. Secondly, the lack of supervision by the Director General of State
Assets (DJKN) on the performance of the Auction Hall in accordance with the
Regulation of the Minister of Finance number 93 / PMK.06 / 2010 concerning
Instructions for Auction, resulting in Winners of Non-Voluntary Executed
Movable Objects Auction Who Do not Receive Minutes of Auction Deed at the
Auction Hall Private
